Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you") and Vladimir Vargas ("Developer," "we," "us") governing your use of PregnancyApp ("Application," "App"). By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Description of Service

PregnancyApp is a mobile application designed to help expectant mothers track pregnancy progress. The App provides the following features:

• Week-by-week pregnancy tracking and fetal development information
• Kick counter tool
• Weight tracking and logging
• Pregnancy reminders and notifications
• Bilingual support (English and Spanish)

The App is available in free (ad-supported) and potentially premium versions.

3. Medical Disclaimer

• The App does not provide medical advice, diagnosis, or treatment
• The App does not replace consultation with qualified healthcare professionals
• Always seek the advice of your physician, obstetrician, or other qualified health provider with any questions regarding your pregnancy
• Never disregard professional medical advice or delay seeking it because of information obtained from the App
• In case of medical emergency, contact your local emergency services immediately

The Developer assumes no responsibility for any consequences arising from the use of information provided by the App.

4. Eligibility

To use PregnancyApp, you must:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into these Terms
• Not be prohibited from using the App under applicable law

If you are under the age of majority in your jurisdiction, a parent or legal guardian must review and accept these Terms on your behalf.

5. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use PregnancyApp for your personal, non-commercial use on a mobile device that you own or control.

This license does not include the right to:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices or labels
• Use the App for any commercial purpose without written consent
• Transferred or sublicense the App to any third party

6. Intellectual Property

All content, code, designs, graphics, logos, icons, text, and software associated with PregnancyApp are the exclusive property of the Developer or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

You may not use, reproduce, or distribute any content from the App without prior written permission from the Developer.

7. User Responsibilities

As a user of PregnancyApp, you agree to:

• Use the App only for its intended purpose
• Provide accurate information when entering pregnancy data
• Not use the App for any unlawful or fraudulent purpose
• Not interfere with or disrupt the App's functionality
• Not attempt to gain unauthorized access to the App or its related systems
• Not use automated tools (bots, scrapers) to access the App
• Comply with all applicable laws and regulations

8. Service Availability

We strive to keep PregnancyApp available and functional at all times. However, we do not guarantee uninterrupted or error-free operation. The App may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues or bugs
• Third-party service interruptions (e.g., Firebase, AdMob)
• Force majeure events

The Developer is not liable for any unavailability or interruption of the App.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind, whether express or implied
• The Developer does not warrant that the App will be error-free, secure, or available at all times
• The Developer is not responsible for any medical decisions made based on information displayed by the App
• The Developer is not liable for any indirect, incidental, special, consequential, or punitive damages
• The Developer's total liability shall not exceed the amount you paid for the App (if applicable) or $0 for the free version

10. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

You may terminate your use of the App at any time by:

• Uninstalling the Application from your device
• Deleting all local data through the App's Settings screen

Upon termination, your right to use the App ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your data.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

• The "Last updated" date will be revised
• Significant changes will be communicated through the App or by email
• Continued use of the App after changes constitutes acceptance of the modified Terms

If you do not agree to the modified Terms, you must stop using the App and uninstall it from your device.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Bolivia. Any disputes arising out of or relating to these Terms shall be resolved in the competent courts of Bolivia.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding the use of PregnancyApp and supersede all prior agreements and understandings.
